In this free brown-bag Zoom lunch gathering (facilitated by BLC’s David Hoffman), we will consider what changes, if any, mediators should make in the wake of the recent decision in Reid v. Kroll. Some mediators who previously drafted agreements are now doing so only if the parties have counsel. What does that mean for mediation parties who can’t afford counsel? Some mediators have decided that they will draft only bullet-point memos when a case settles, but where does that leave the parties on issues that a more complex draft addresses?
